About us and acceptance
The Talking Quest is a subscription service operated by Cuteness Exposed ("Cuteness Exposed", "we", "us", "our"). By creating an account, subscribing, or otherwise using our website and content (the "Service"), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Service. These terms apply to everyone who accesses the Service, including visitors browsing free content and paid subscribers.
Who can use the Service
You must be at least 18 years old to create an account, purchase a subscription, or agree to these terms on behalf of your household. The Talking Quest is designed for parents, carers and other trusted adults to use together with the children in their family. Children may use the scenarios and questions under the supervision of a registered adult account holder. We do not knowingly collect personal information directly from children — see our Privacy Policy.
Your account
To use paid features you create an account with your full name and email address, and you sign in using a one-time email code (there is no password). You are responsible for keeping access to your email and account secure, and for activity that occurs under your account. Tell us straight away at hello@talkingquest.com if you believe someone else has gained access. One subscription is intended for one household; please do not share your account outside your immediate family, which also protects the licensed content described in Section 6.
Subscriptions, billing and automatic renewal
We offer a free plan and paid subscription plans. The current plans, prices and what each includes are always shown on our Pricing page, in the currency stated there. Billing is administered on our behalf through Marketing Parlour, and payments are processed by Stripe under Stripe's terms and privacy policy; by subscribing you also authorise these parties to charge your chosen payment method.
Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or yearly, as selected) at the then-current price, and your payment method is charged unless you cancel before the renewal date. By subscribing you consent to these recurring charges until you cancel.
Taxes. Prices may be shown exclusive or inclusive of GST, VAT or sales tax depending on your location; any applicable taxes are added or included as required by law.
Price changes. If we change subscription pricing, we will give existing subscribers reasonable advance notice before the new price applies to their next renewal, and you may cancel before then if you do not agree.
Refunds and your consumer rights
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. If a product is faulty or not as described, you are entitled to a remedy, which may include a refund.
If you're in the UK or EU, nothing in these terms affects your statutory rights; note that for digital content supplied immediately you agree we may start supplying it straight away, and to the extent permitted this affects the statutory 14-day cancellation right. If you're in the United States, nothing here limits any rights you have under applicable law.
Because our paid membership is digital content delivered immediately, we are not generally required to offer a refund if you simply change your mind. If something is wrong with what you bought, contact us at hello@talkingquest.com and we will work with you to put it right.
Membership and cancellation
Your membership renews automatically — monthly or yearly, depending on your plan — at the current price, until you cancel. You can cancel any time from your account; cancellation takes effect at the end of the current paid period and you keep access until then. Except where the law requires, we don't provide partial refunds for the unused part of a period.
Content licence and acceptable use
Paid scenarios and other member content are for your family's own private use — not for sharing, copying, or posting anywhere else.
When you subscribe, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service — including our scenarios, conversation questions, articles, illustrations and other site content — for your own household's private, non-commercial use. You agree not to:
- copy, screenshot, save, download, print, redistribute, resell or publicly post any content from the Service;
- share your account or downloaded content with people outside your household;
- use automated tools to scrape, bulk-download or reproduce content; or
- remove or bypass any content-protection measures.
This licence ends if your subscription lapses or your account is terminated.
AI-generated content
Some content on the Service — including certain scenarios, articles and illustrations — is created or assisted using artificial-intelligence tools and reviewed by a person before publication. AI-assisted content is provided on an "as is" basis for general information and conversation only. While human-reviewed, it may occasionally contain errors, omissions or content that does not fit your family's situation, and you are responsible for using your own judgement about what is appropriate for your child. As set out in our Privacy Policy, we do not use AI to make automated decisions about you and we do not put your personal information into AI systems.
Not professional advice
The Talking Quest is built to spark everyday family conversations. It is not therapy, counselling, or medical, psychological, educational or legal advice, and it is not a substitute for professional support. If your family is dealing with a serious or urgent concern, please speak with a qualified professional or, in an emergency, contact your local emergency services.
Intellectual property
The Talking Quest name, logo, website design, and all scenarios, questions, articles and illustrations are owned by or licensed to Cuteness Exposed and protected by copyright and other intellectual-property laws. Nothing in these terms transfers ownership of that content to you; Section 6 describes the limited licence you receive.
Partner discounts
Some plans may include a discount at partner sites (for example, Parents WiredIn and future partner projects). These discounts are offered at our discretion, may change or be discontinued, and are subject to the partner site's own terms, pricing, stock and checkout process, which we do not control.
Third-party services
The Service relies on third parties including Stripe (payments) and our hosting, email and analytics providers. Your use of those services may be subject to their own terms; we are not responsible for third-party services outside our control.
Community guidelines
If your plan includes access to our parent community, please be respectful of other parents, keep shared content within the group private, and do not use the community to advertise unrelated products or services. We may remove members who do not follow these guidelines.
Suspension and termination
You can close your account at any time from account settings. We may suspend or terminate accounts that breach these terms, misuse the content licence in Section 6, or engage in conduct harmful to other users or to the Service. Where your breach is capable of remedy, we will where reasonable give you an opportunity to fix it first.
Disclaimers and limitation of liability
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we do not warrant that the Service will be uninterrupted or error-free, or that any particular scenario or approach will produce a particular outcome for your family. To the fullest extent permitted by law, Cuteness Exposed will not be liable for indirect, incidental, special or consequential loss, and our total liability to you for any claim connected with the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded — including under the Australian Consumer Law, the UK Consumer Rights Act 2015, or applicable US state law. Where our liability cannot be excluded but can be limited, it is limited to resupplying the Service or paying the cost of resupply.
Changes to these terms
We may update these terms from time to time. If we make a material change we will update the "Last updated" date above and, where reasonable, notify subscribers by email. Continuing to use the Service after a change takes effect means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State. If you are a consumer, you may also have the benefit of mandatory rights and the courts of the country where you live, and nothing here deprives you of those rights.
